S.O.S. Helmet Terms and Conditions

Welcome to S.O.S. Helmet. These Terms and Conditions ("Terms") govern your access to and use of the S.O.S. Helmet service ("Service"), provided by S.O.S. Helmet. Acceptance of these Terms is a necessary condition for creating an account and using the Service.

1. Object of the Service

S.O.S. Helmet provides the user ("User") with an emergency medical identification system. The Service consists of an adhesive tag equipped with NFC/QR code technology to be applied to one's helmet and a web platform where the User can register and manage a profile containing their medical data and emergency contacts. In the event of an accident, anyone scanning the tag will be able to view such information in order to facilitate first aid operations.

2. Registration and Account Creation

  • To use the Service, you must create an account by providing a valid email address and password.
  • The User is responsible for the custody and security of their access credentials. Any activity carried out through their account will be considered as carried out by the User.
  • Only one account per natural person is allowed.

3. User Obligations and Responsibilities

  • The User is solely and exclusively responsible for the truthfulness, accuracy, completeness, and updating of the medical information and emergency contacts entered in their S.O.S. Helmet profile.
  • S.O.S. Helmet does not verify the correctness of the health data provided and acts merely as a technological platform provider for their display in an emergency.
  • The User understands and accepts that entering inaccurate, incomplete, or outdated information could compromise the effectiveness of the rescue and potentially cause harm to their health. It is the User's burden to keep their data constantly updated.
  • The User agrees to use the Service lawfully and in compliance with these Terms, without violating the rights of third parties or applicable laws.

4. Service Operation and Risk Awareness

  • The User is fully aware that the fundamental feature of the Service is to make medical profile data publicly accessible to anyone scanning the NFC/QR tag.
  • S.O.S. Helmet cannot guarantee that in an emergency situation rescuers will be equipped with the tools to scan the tag or that they will choose to do so. The Service is a support tool and does not replace traditional medical alert systems or standard first aid procedures in any way.
  • The integrity and correct positioning of the adhesive tag on the helmet are the responsibility of the User. Physical damage to the tag could render it unreadable.

5. Limitation of Liability

To the maximum extent permitted by law, S.O.S. Helmet shall not be held liable for any direct or indirect damages arising from:

  • a) Failure or incorrect use of the Service by the User.
  • b) Incorrect, incomplete, or outdated medical information entered by the User.
  • c) Failure to scan or unreadability of the tag by third parties or rescuers.
  • d) Service interruptions due to technical maintenance, force majeure, or connectivity problems beyond our control.

S.O.S. Helmet's liability is limited to the provision of the technological platform as described in Art. 1.

6. Intellectual Property

The name "S.O.S. Helmet", the logo, the website, the software, and all related content are the exclusive property of S.O.S. Helmet and are protected by copyright and intellectual property laws.

7. Suspension and Account Closure

  • The User may delete their account at any time through their reserved area. Deletion will result in the permanent elimination of all associated data, as described in the Privacy Policy.
  • We reserve the right to suspend or close an account, without notice, if the User violates these Terms or uses the Service fraudulently or illegally.

8. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective from the moment of their publication on the site. We will notify Users of substantial changes via email. Continued use of the Service after such changes constitutes acceptance of the new Terms.

9. Governing Law and Jurisdiction

These Terms are governed by Italian law. For any dispute arising in relation to the interpretation, execution, or validity of these Terms, the competent court shall be that of the User's residence or domicile, if a consumer.
